3. COMMISSION PRICE & PAYMENT
Total Commission Price: $________________

A 50% deposit is required before work begins unless otherwise agreed upon in writing. The remaining balance is due upon completion and before the artwork is released or shipped to the client.
The deposit reserves the artist's time and materials for the project and is non-refundable once work has begun, except where otherwise agreed upon by both parties.
The artist will not be obligated to release the completed artwork until the balance has been paid in full.
4. COMPLETION TIME
The estimated completion date is:
Estimated Completion: _________________________________
Completion times may vary depending on the size and complexity of the artwork, the artist's current schedule, and the availability of necessary reference materials. The artist will make every reasonable effort to complete the work within the estimated timeframe.
If circumstances arise that substantially delay the commission, the client will be notified.
5. CHANGES & REVISIONS
The client may communicate reasonable preferences regarding the commissioned artwork before and during the creative process. Minor adjustments may be made when practical.
Because a commissioned artwork is an original artistic creation, the client understands that the finished piece may not be an exact reproduction of a photograph or reference image.
Significant changes requested after the artwork has been substantially completed may result in additional charges. Any additional costs will be discussed with and approved by the client before the additional work is performed.
6. FINAL APPROVAL
When the artwork is substantially completed, the artist may provide the client with a photograph of the finished piece for approval, when practical.
Once the artwork has been approved and the final payment has been received, substantial changes to the artwork will not normally be permitted.
7. SHIPPING & DELIVERY
Shipping or delivery costs are not included in the commission price unless specifically stated otherwise.
Shipping/Delivery Cost: $________________
The artwork will be packaged with reasonable care for delivery. Once the artwork has been shipped to the address provided by the client, the artist is not responsible for delays caused by the shipping carrier.
The client is responsible for providing an accurate delivery address.
8. CANCELLATION
If the client cancels the commission before work begins, the deposit may be refunded at the artist's discretion, less any materials or expenses already incurred.
If the client cancels after work has begun, the deposit will generally be retained to compensate the artist for time, materials, and work committed to the project. If substantial work has already been completed, the client may be responsible for additional costs corresponding to the work completed.
If the artist is unable to complete the commission for reasons within the artist's control, the artist will communicate with the client and, where appropriate, provide a refund for payments relating to work that has not been completed.
9. COPYRIGHT & OWNERSHIP
Upon full payment, the client becomes the owner of the physical original artwork, unless otherwise agreed in writing.
Copyright and reproduction rights remain with the artist, Nigel Morgan. Purchasing the original artwork does not transfer the artist's copyright to the client.
The artist retains the right to photograph, reproduce, display, and use images of the commissioned artwork for purposes including, but not limited to, the artist's website, portfolio, exhibitions, social media, advertising, publications, and promotional materials.
The client may display the original artwork for personal enjoyment but may not reproduce, sell reproductions of, or commercially distribute images of the artwork without the artist's written permission.
10. REFERENCE MATERIALS
The client represents that they have permission to provide any photographs, images, or other reference materials used for the commission, or that such materials are their own.
The artist will not knowingly reproduce copyrighted material belonging to another person without appropriate permission.
11. ARTISTIC INTERPRETATION
The client understands that a commissioned artwork is an original creative work and that artistic interpretation is an important part of the process.
Differences in color, texture, composition, lighting, brushwork, or other artistic elements between a reference photograph and the finished artwork are to be expected and are not considered defects.
